Special Needs Children To Be Force Vaccinated By Courts

SB277 has become the law of the land. And with it, the slippery slope of decimating rights has begun. As it stands, beginning in 2016, parents who choose not to vaccinate their children will not be allowed to enroll them in public education. That’s bad enough, of course, but the situation has worsened greatly. 

The Orange County Department of Education Legal Division has sent out documents to county school
superintendents and nurses, and anyone with any relative authority over a county public school. The issue it comments on is the issue of special needs children who use the Individualized Education Program and their relationship to SB277. The IEP helps disabled children by creating a learning and communications environment that best serves them. They also, of course, fall under the SB277 umbrella. However, the documents sent out advising how to handle these specific children is frightening and seems to encourage getting court orders to force vaccinate them. 

“Our office interprets this provision as meaning that special education students
must be enrolled even if they are not vaccinated, but that special education
students are still required to be vaccinated and the parents of the special education
students need to comply with the provisions of Senate Bill 277. The language of
Senate Bill 277 does not specify any penalties or remedies if parents refuse to
vaccinate their children. However, school districts may, if necessary, after
advising parents in writing of the legal requirements of Senate Bill 277, contact
the Orange County Health Care Agency for assistance or seek a court order
ordering parents to vaccinate their children.” 


This would mean school districts would potentially utilize the option of seeking legal means to force vaccinate disabled children. A court order would mandate the vaccination, beyond the current legal exemptions offered. In some ways, they’d be vaccinated like wards of the state. This could also mean autistic children in recovery being subjected to further vaccinations. 

SB277 continues to prove itself a worthy and capable opponent to our basic human rights. Clearly, the state of California intends upon looking for every possible slither of possibility in expanding that decimation. It’s important that we all continue to remain informed and support the publications putting this information on the forefront.
